The star witness at trial was Atchley\u2019s insurance agent. The agent met with Atchley after his arrest to talk about the life insurance policy on his wife. During this conversation Atchley admitted to lying in wait for his wife with a gun, but said that the shooting was an accident.  After notifying police, the insurance agent returned with a hidden recording device. Atchley made the same admission. Over Atchley\u2019s objection the tape was admitted at trial. The Supreme Court of California affirmed the conviction.\u003C\/p\u003E\n\u003Cp\u003EAtchley then sought habeus corpus relief in the U.S. District Court for the Northern District of California, arguing that the tape was an unconstitutional involuntary confession. The district court agreed, ordering a new hearing on the issue of voluntariness. The district court held that the trial could not have reliably determined whether the confession was voluntary. The U.S. Court of Appeals for the Ninth Circuit affirmed.\u003C\/p\u003E\n","question":"\u003Cp\u003EDid the district court err in refusing to apply a presumption of correctness to the California state courts\u2019 finding that Atchley\u2019s tape recorded statement was voluntary?\u003C\/p\u003E\n","conclusion":"\u003Cp\u003EJustice Potter Stewart, writing for eight members of the court, delivered the majority opinion. The Supreme Court held that an applicant for habeus corpus is not entitled to a new hearing on voluntariness unless he can show that his version of events, if true, would require the conclusion that the confession was involuntary. In this case, Atchley did not do that. He merely pointed to shortcomings in the trial court procedures. The trial court had given full consideration to the issue of voluntariness and applied the correct constitutional standard.\u003C\/p\u003E\n\u003Cp\u003EJustice Hugo L.
