The practice granted the aliens \u201cspecial immigrant\u201d status and authorized them to be \u201clawfully admitted for permanent residence\u201d even though the workers did not intend to reside in the U.S. permanently.  This \u201cspecial\u201d status, authorized under the Immigration and Nationality Act, exempted the workers from normal documentation requirements.  The United Farmworkers Organizing committee sued for injunctive relief from the practice.  The district court dismissed the case, but the U.S. Court of Appeals for the District of Columbia Circuit held that special status was permissible for daily workers, but not for seasonal workers.\u003C\/p\u003E\n","question":"\u003Cp\u003EIs it proper for the INS to grant aliens who commute to the U.S. from Canada and Mexico the ability to be \u201clawfully admitted for permanent residence\u201d?\u003C\/p\u003E\n","conclusion":"\u003Cp\u003EYes.  In a 5-4 decision, Justice William O. Douglas wrote for the majority affirming the lower court as to daily workers, but reversing as to seasonal workers.  The Supreme Court held that even if workers did not intend to reside in the U.S., they were still entitled to the ability to do so.  The Court noted that the practice was longstanding and had since Congress had impliedly approved it.  Justice Byron R. White wrote a dissent, stating that the plain meaning of the statute did not allow foreign commuters to be considered \u201cpermanent residents\u201d.
