On April 16, 1973, about two months before his second trial was set to begin, Wiggins filed a request for counsel and rescinded his earlier waiver. His feelings toward his standby counsel remained volatile throughout the trial. Wiggins was convicted in his second trial. He moved for a new trial and argued that his standby counsel interfered with his defense, but the court denied the motion. After he exhausted direct appellate and state habeas relief, Wiggins petitioned for federal habeas relief in district court. The Court held that the Sixth Amendment does not guarantee the right to self-representation completely free from the presence of standby counsel. Rather, the Sixth Amendment protects the defendant\u2019s right to \u201ccontrol the organization and content of his own defense.\u201d The Court held that Wiggins was afforded all appropriate rights and that the presence of standby counsel did not interfere with the exercise of these rights.\u003C\/p\u003E\n\u003Cp\u003EJustice Harry A.
