The complaint alleged that execution by lethal gas constitutes cruel and unusual punishment in violation of the Eighth Amendment. Just hours before Harris was scheduled to be executed, the U.S. Court of Appeals for the Ninth Circuit issued an order to stay the execution, and the state appealed the stay to the Supreme Court.\u003C\/p\u003E\n","question":"\u003Cp\u003EShould the order staying Harris\u2019 execution be vacated?\u003C\/p\u003E\n","conclusion":"\u003Cp\u003EYes. Because the state\u2019s authority to impose a punishment depends entirely on its constitutionality, Harris\u2019 delay in raising the claim was immaterial in Justice Stevens\u2019 view.
