Justice Byron R. White delivered the opinion of the 5-4 majority. The Court held that a decision in favor of Graham would create a new constitutional rule by extending beyond the reasoning of the precedents that were in place at the time of the conviction. Unless a jurist at the time of Graham\u2019s conviction could have found reasonable precedent to decide the case in his favor, to do so now would extend beyond the Court\u2019s purview. Since the precedent at the time would not have provided a valid reason to overturn Graham\u2019s sentence, the Court found that it must uphold it.\u003C\/p\u003E\n\u003Cp\u003EIn his concurring opinion, Justice Clarence Thomas wrote that he fully supported the Court\u2019s decision. He argued that the specific questions a sentencing jury is asked to consider before sentencing a defendant to death make the consideration of mitigating factors redundant.\u003C\/p\u003E\n\u003Cp\u003EJustice John Paul Stevens wrote a dissent where he argued that the consideration of mitigating factors by a sentencing jury is a crucial safeguard against discriminatory sentencing. He strongly disagreed with Justice Clarence\u2019s view that Penry v. Lynaugh was wrongly decided.\u003C\/p\u003E\n\u003Cp\u003EIn his dissenting opinion, Justice David H.
