Spencer then filed a federal habeas petition, alleging that he had not received due process in the parole revocation proceedings. In 1993, Spencer was re-released on parole before the District Court addressed the merits of his habeas petition. Subsequently, the court dismissed Spencer\u0027s petition as moot. The Court of Appeals affirmed.\u003C\/p\u003E\n","question":"\u003Cp\u003EMay prison inmates challenge the revocation of their parole after they are re-released on parole?\u003C\/p\u003E\n","conclusion":"\u003Cp\u003ENo. In a 8-1 opinion delivered by Justice Antonin Scalia, the Court held that the expiration of Spencer\u0027s sentence caused his petition to be moot because it no longer presented an Article III case or controversy. The Court concluded that once a petitioner\u0027s sentence has expired he must demonstrate a concrete and continuing injury to maintain suit.
