Ryan\u0027s attorneys claimed that they were not making a new claim - the diversion had been alluded to in other court documents - but that they were merely refocusing the judge\u0027s attention. Furthermore, they argued that the deadline for filing could be - and had been - waived by the judge. Kontrick\u0027s attorneys, on the other hand, argued that the amended complaint was a new filing and that the deadlines for filing could not be waived. The bankruptcy court ruled for Ryan.
