Beard, the Secretary of the PA Department of Corrections, argued that this policy was necessary to promote rehabilitation and ensure prison safety. Banks brought a suit challenging the policy as a violation of the First Amendment. On the recommendation of a Magistrate Judge, the District Court ruled in favor of Beard. On appeal, however, the Third Circuit Court of Appeals reversed. The Circuit Court found that the prison\u0027s policy failed to meet the test laid down by the Supreme Court in \u003Cem\u003ETurner v. Safley\u003C\/em\u003E. Safley\u003C\/em\u003E : (1) it was rationally related to the legitimate penological goal of motivating good behavior; (2) though prisoners had no alternate means of exercising their rights, they could potentially graduate to the less-restrictive level 1; (3) accommodating prisoners\u0027 rights could result in negative consequences (worse behavior); and (4) there was no alternate means of accomplishing the prison\u0027s goals without restricting the prisoners\u0027 rights. Justice Thomas concurred separately in an opinion joined by Justice Scalia, arguing that \u0022This case reveals the shortcomings of the \u003Cem\u003ETurner\u003C\/em\u003E framework.\u0022 Justices Stevens and Ginsburg both wrote dissents.
