On appeal, the U.S. Court of Appeals for the Sixth Circuit dismissed the suit because the Winkelmans lacked a lawyer. Also, because the IDEA demands active parental involvement in order to enforce proper child placement, the parent should be able to appear in court \u0022pro se\u0022 - without a lawyer. The Sixth Circuit rejected both arguments and held that the IDEA does not establish any right of a non-lawyer parent to represent his disabled child in federal court.
