The clause can be invoked to exclude evidence that would involve legislative acts, but the D.C. Circuit ruled that it is not a blanket ban on suits involving legislative employees. The employee would simply have to make his case without questioning legislative acts or motivations for legislative acts. Senator Dayton appealed directly to the Supreme Court, arguing that the Accountability Act requires the Court to hear the appeal.
