Therefore, the Court sent the case back down to the Ninth Circuit in order to provide an opportunity to revisit these factual findings. Justice Ruth Bader Ginsburg wrote a concurring opinion stating that she believed the Court should have waited to hear the case until all the facts had been uncovered.
