Upon searching Herring\u0027s vehicle, officers discovered methamphetamine in Herring\u0027s pocket and a gun under the seat of his truck. However, the situation was complicated by the fact that the initial search had been made on a faulty arrest warrant. The warrant, still active in the neighboring Dale County Sheriff\u0027s Office, was supposed to have been recalled five months prior, however someone had accidentally failed to remove it from the computer system. Herring filed a motion to suppress the allegedly \u0022illegally obtained\u0022 evidence, however the U.S. District Court for the Middle District of Alabama denied Herring\u0027s motion and sentenced him to 27 months in prison.\u003C\/p\u003E\n\u003Cp\u003EThe U.S. Court of Appeals for the Eleventh Circuit affirmed the conviction, stating that illegally obtained evidence should only be suppressed when doing so could \u0022result in appreciable deterrence\u0022 of future police misconduct. Alito Jr., the Supreme Court affirmed the U.S. Court of Appeals for the Eleventh Circuit. It held that a criminal defendant\u0027s Fourth Amendment rights are not violated when police mistakes that lead to unlawful searches are merely the result of isolated negligence and \u0022not systematic error or reckless disregard of constitutional requirements.\u0022 Evidence obtained under these circumstances is admissible and not subject to the exclusionary rule.\u003C\/p\u003E\n\u003Cp\u003EJustice Ruth Bader Ginsburg dissented and was joined by Justice John Paul Stevens, Justice David H. Souter, and Justice Stephen G. Breyer. Justice Ginsburg argued that an intact exclusionary rule provides a strong incentive for police compliance with respect to the Fourth Amendment and its erosion in this case was not warranted. Justice Breyer also filed a separate dissenting opinion and was joined by Justice Souter.
