Scalia, Anthony M. Kennedy, Clarence Thomas, Samuel Alito, and Sonia Sotamayor, and Justice Stephen G. Breyer as to Part II. Justice John Paul Stevens dissented joined in part by Justice Breyer. The majority recognized that the Florida Supreme Court relied in part on its own state Constitution in addition to \u003Cem\u003EMiranda\u003C\/em\u003E in reaching its decision. However, Justice Ginsburg reasoned that when a state court decision fairly appears to rest on federal law, or is interwoven with federal law, and the adequacy and independence of the state-law ground is unclear from the opinion, as in this case, it is presumed that federal law controlled the state court\u0027s decision.
