The KWP and LTTE engage in a variety of both lawful and unlawful activities. They sought an injunction to prevent the government from enforcing sections of the Antiterrorism and Effective Death Penalty Act (\u0022AEDPA\u0022). Section 302 authorizes the Secretary of State to designate a group as a \u0022foreign terrorist organization.\u0022 Section 303 makes it a crime for anyone to provide \u0022material support or resources\u0022 to even the nonviolent activities of a designated organization. In previous cases, the courts have held that Section 303 was unconstitutionally vague. Congress then passed the Intelligence Reform and Terrorism Prevention Act (\u0022IRTPA\u0022) which amended the AEDPA. It added a state of mind requirement that individuals \u0022knowingly\u0022 provide \u0022material support or resources\u0022 in order to violate the Act. Congress also added terms to the Act that further clarified what constituted \u0022material support or resources.\u0022 The government moved for summary judgment arguing that challenged provisions of the AEDPA were not unconstitutionally vague. Here, the statutory terms at issue -- \u0022training,\u0022 \u0022expert advice or assistance,\u0022 \u0022service,\u0022 and \u0022personnel\u0022 -- are not similar to terms like \u0022annoying\u0022 and \u0022indecent\u0022 that the Court has struck down as being too vague.
