Thompson filed a complaint, which alleged that he was fired in retaliation for Regalado\u0027s EEOC charge. Retaliating in that way, Thompson asserted, violated section 704(a) of Title VII, which forbids an employer to \u0022discriminate against any of his employees ... because he has... made a charge ... under this title.\u0022 The U.S. District Court for the Eastern District of Kentucky dismissed Thompson\u0027s complaint, holding that Title VII \u0022does not permit third party retaliation claims.\u0022 A divided panel of the U.S. Court of Appeals for the Sixth Circuit upheld the lower court order. But the court of appeals granted the employer\u0027s petition for rehearing en banc.
