Roberts, Jr. delivered the opinion for the 5-4 majority. The Court held that rules limiting speech in charitable solicitation contexts have typically been subjected to strict First Amendment scrutiny because such speech often deals with issues of public concern in precisely the manner the First Amendment was meant to protect. Therefore, the government may only restrict the speech of a judicial candidate when the restriction is narrowly tailored to serve a compelling state interest. The Court held that the restriction in this case serves the compelling state interest of preserving public confidence in the integrity of the judiciary and is sufficiently narrowly tailored to that interest.
