The TDMV had a policy stating that it \u0022may refuse to create a new specialty license plate if the design might be offensive to any member of the public.\u0022 The board in charge of approving new specialty plates received multiple negative comments from the public regarding this plate and ultimately voted to deny Texas SCV\u0027s application.\u003C\/p\u003E\n\u003Cp\u003ETexas SCV sued in federal district court claiming their First and Fourteenth Amendment rights were violated. The TDMV argued that the Free Speech Clause did not apply in this case because license plates are a form of government speech; therefore, they were within their rights to choose which messages and views they wanted to express on the plates. The district court disagreed and held that the plates were private, non-governmental speech, and that the TDMV\u0027s denial was a reasonable, content-based restriction of speech in a non-public forum. The United States Court of Appeals for the Fifth Circuit reversed and held that TDMV\u0027s denial was a form of viewpoint discrimination that \u0022discriminated against Texas SCV\u0027s view that the Confederate flag is a symbol of sacrifice, independence, and Southern heritage.\u0022\u003C\/p\u003E\n","question":"\u003Cp\u003E1. Breyer delivered the opinion of the 5-4 majority. The Court held that the government choosing the content of its speech is not unconstitutional viewpoint discrimination because that expression is the product of the democratic electoral process. Based on the analysis from \u003Cem\u003EPleasant Grove City v. Summum\u003C\/em\u003E, Texas\u2019s specialty license plate is an example of such government speech (as opposed to a forum open for private expression) because Texas and other states have long used license plates to convey messages. Moreover, the public associates license plates with the State.
