The district court held that the provision was unconscionable due to its placement near the bottom of the employment contract with no effort to highlight or draw attention to the provision, the fact that MHN is a major corporation whose bargaining power and finances put it in a superior position to the plaintiffs during arbitration, and the fact that the arbitration provision of the employment contract allowed for limited discovery.
