In previous decisions, some members of the Court have also expressed the view that complying with the Voting Rights Act, which prohibits redistricting plans that effectively disenfranchise minorities, is a legitimate consideration. Precedent has also established that, while deviations of more than 10% may be presumed to represent invidious discrimination, deviations of less than 10% must be shown to be the result of illegitimate considerations, and such evidence was not present in this case.
