Arizona\u003C\/em\u003E. Justice Sonia Sotomayor delivered the opinion for the 8-1 majority. The Court held that the Sixth Amendment requires a jury, not a judge, to find each element necessary to impose the death sentence. Although the Florida sentencing scheme required that the jury recommend a death sentence in order to impose the death penalty, the judge was only required to take the jury recommendation under consideration. Because the Supreme Court held in \u003Cem\u003ERing v. Arizona\u003C\/em\u003E that the Sixth Amendment required that a jury make all the critical findings necessary to impose the death penalty, the Florida sentencing scheme violated the Sixth Amendment in the same way the Arizona one did in \u003Cem\u003ERing\u003C\/em\u003E. In his opinion concurring in the judgment, Justice Stephen G. Breyer wrote that the Eighth Amendment required jury sentencing in capital cases.\u003C\/p\u003E\n\u003Cp\u003EJustice Samuel A. Alito, Jr. wrote a dissent in which he argued that that the Sixth Amendment did not require that a jury make the specific findings authorizing the imposition of the death penalty. The Florida sentencing scheme is different from the one the Supreme Court found unconstitutional in \u003Cem\u003ERing v. Arizona\u003C\/em\u003E because in the Arizona scheme the jury did not make any recommendation about the death penalty at all.
