In 2011, Husky filed a complaint against the discharge of Ritz\u2019s debt and argued that Ritz had fraudulently moved funds from Chrysalis to other accounts in order to file for bankruptcy. The bankruptcy court found that Ritz had not fraudulently filed for bankruptcy and that it could not \u201cpierce the veil\u201d to go after Ritz\u2019s personal finances for the debt Chrysalis owed.\u003C\/p\u003E\n\u003Cp\u003EHusky appealed to the district court, which affirmed the bankruptcy court\u2019s determination and found that Ritz had not committed \u201cactual fraud\u201d by false representation and that Husky had not proven that Ritz acted \u201cmaliciously and willfully.\u201d The United States Appeals Court for the Fifth Circuit affirmed the lower court\u2019s decision to discharge Ritz\u2019s debt.\u003C\/p\u003E\n","question":"\u003Cp\u003EIs fraudulently transferring money to avoid repayment of a debt considered false representation under bankruptcy statute 11 U.S.C. \u00a7523(a)(2)(A) to prevent discharge of the debt?\u003C\/p\u003E\n","conclusion":"\u003Cp\u003EThe \u201cactual fraud\u201d language of the bankruptcy statute encompasses traditional forms of fraud and is not limited to fraudulent representation. Justice Sonia Sotomayor delivered the opinion of the 7-1 majority. The Court held that \u201cactual fraud\u201d is fraud that is committed with wrongful intent, and that \u201cfraud\u201d has traditionally been defined as any transfer of assets that impairs a creditor\u2019s ability to collect on the debt. In the common law, such fraudulent conveyances did not require that the debtor make a false representation to the creditor. Therefore, historically, false representation has never been a requirement of \u201cactual fraud\u201d and should not be treated as one in the wording of the relevant section of the Bankruptcy Code. This reading maintains meaningful distinctions throughout the code and does not make the language redundant.\u003C\/p\u003E\n\u003Cp\u003EIn his dissent, Justice Clarence Thomas argued that \u201cactual fraud\u201d as used in the relevant section of the bankruptcy statute does not encompass fraudulent transfer schemes. Despite the fact that the common law meaning of actual fraud is expansive, this case is one of statutory interpretation, not common law, and therefore the common law definition cannot be dispositive when it does not fit with the relevant language of the statute. The relevant language in this case limits \u201cactual fraud\u201d to situations in which fraud induced the creditor to enter into a transaction with the debtor.
